(5) If Mr. Duncan be regarded as senior in point of

service in the grade of lat. rado Astiftant EnginJers

be would, under the above quoted Genu. :1 Order and by

virtue of the precedents referred to in (2) and (3), ba

selectad to fill the first vacancy in a higher rank.

(6) There would appear to be no object in having

Camierity unless it be that seniority plnovs an officer

in a more favourable pozivien za rugarda promotion.

(7) I cannot think that är. Duncan would have desired

weniority had he not expected to deriye köpö advantage

from it, and the Government, by granting seniority, would

appear to have unintentionally encouraged his expecta----

-tions as regards promotion.

When a vacancy in the grade of Assistant Enginour is filled

the new officer usually ontors into an agreement for three years, on

the termination of which period he is transferred to the permanent

staff. His seniority is determined from the date he first entured

the service of the Government.

Mr. Duncan came into the service of the

special agrement, his appointm-nt being one which had no connection whatever with tho porannent etaff. On completion of the period

provided for in the agreement if he come on to the permanent staff

his seniority can, I submit, only be determined from the date he

joined the service.

Hr. Duncan entered the Larvice of the Government on the 22nd.

May, 1911.

I entered the service of the foverment on the le. January

1910.

By the granting to ar. Duncan of the seniority in question, I shall love a considerable degree of seniority which must prove to be to my great detriment; and the lose that I shall thereby be subjected to will have been couled by the promotion of a man who in

3 years my junior in age and nearly one and a half years my junior

in the service.
